Liberty Mutual customers may claim up to $25,000 in class action settlement — check if you qualify
Summary
A class action settlement has been reached with Liberty Mutual Insurance Co. and related companies, potentially awarding up to $25,000 to eligible customers in New Mexico. The lawsuit alleged that Liberty Mutual did not properly disclose a rule that reduced underinsured motorist claim payments by amounts already received from at-fault drivers’ insurance. While the companies maintain they did nothing wrong, they agreed to the settlement to avoid further legal costs.
To qualify, individuals must have held an automobile insurance policy with Liberty Mutual, its affiliates, or Safeco in New Mexico between October 1, 2010, and March 31, 2022, and filed an underinsured motorist claim during that period. The policy must not have clearly stated that claim values would be reduced by payments from the at-fault driver’s insurer. Those eligible may receive a direct payment or a partial refund of premiums.
Claim forms must be submitted by April 30, 2026, either online or by mail to the Settlement Administrator. Some policyholders may receive automatic payments and do not need to submit a claim. Final settlement payments will be distributed after a court approval hearing on June 2, 2026, with the amount received potentially varying based on the number of valid claims filed.
