The payouts, which will average around $333 per claim, are expected to reach approximately six million people who filed claims by the November 2021 deadline. After deducting attorney fees and administrative costs, only $1.9 billion of the total settlement fund is available for distribution. The settlement resolves a 2013 lawsuit alleging that BCBS and its member plans violated antitrust laws by limiting market competition, which allegedly led to higher premiums and fewer options for consumers. Eligibility was restricted to individuals and insured groups who were customers between February 7, 2008, and October 16, 2020, as well as self-funded accounts active during a specific period in 2015 to 2020. Customers who failed to file a claim by the November 5, 2021, deadline are not eligible for these payments.
