Lawsuit expired: court dumps former official’s multimillion-rand case

Timeslive
A Pretoria high court judge dismissed a former employee's multimillion-rand lawsuit due to missed statutory deadlines.

Summary

The Pretoria high court has dismissed a multimillion-rand lawsuit filed by former government employee Thandeka Mxenge against two state departments. Judge Anthony Millar ruled that the claim had legally expired because Mxenge's legal teams failed to meet critical deadlines. Mxenge was fired in July 2018 and won an arbitration award in September 2019, which ordered her reinstatement and payment. However, she did not initiate legal proceedings until October 2021, missing the three-year window required by the Prescription Act. The court found that the summons was served two days outside the prescribed period and that Mxenge failed to demonstrate good cause for the delay. Millar also ordered Mxenge to pay the legal costs of the state departments.
