City of Toronto, security contractor trade blame in $32M lawsuit defences
Summary
Former employees of One Community Solutions (OCS), known as community safety team members or CSTs, have filed a proposed $32 million class-action lawsuit against OCS, the City of Toronto, and the Toronto Transit Commission. The allegations include wage theft, wrongful dismissals, and other labour law violations. In their statements of defence, both OCS and the City of Toronto deny the allegations but suggest the other party should be held responsible if any wrongdoing is found. OCS argues that if former employees are owed statutory wages, the City and TTC acted as a "common employer" and should be liable. The City and TTC maintain that OCS was fully responsible for its personnel under the contract terms. The class action has not yet been certified.
