The lawsuit claims the company accepted deposits for residential pool construction but either failed to complete the work or caused property damage, affecting 25 customers who lost a total of $1.7 million. It seeks a permanent injunction barring Carter from owning or operating any Indiana home improvement business and consumer restitution for losses.
The Better Business Bureau has issued a warning about Smarter Pools, citing a pattern of collecting down payments without finishing work and being unresponsive to customers. Carter also faces pending fraud and theft charges in Hamilton County related to his pool contracting. An I-Team encounter at Carter’s residence showed him declining to comment on behalf of his attorney. The company’s website is no longer active, and courts have already entered judgments totaling $208,699 against the contractor since April 2025.
