Proposed class-action lawsuit launched by Lapu Lapu attack survivor
Summary
A man severely injured during the SUV rampage at the Lapu Lapu Day festival in Vancouver has filed a proposed class-action lawsuit against the City of Vancouver, Vancouver Coastal Health, and the driver, Kai-Ji Adam Lo. The suit alleges negligence on the part of the city and health authority in failing to recognize and address the risks posed by Lo, who had a history of mental health issues and had expressed increasingly paranoid delusions in the weeks leading up to the event. It claims inadequate security measures were in place at the festival, with only wooden sawhorses used as barriers despite the potential for vehicle attacks. The lawsuit also asserts that Vancouver Coastal Health failed to adequately treat Lo’s deteriorating mental health. The plaintiff, John Lind, suffered multiple injuries and PTSD as a result of the attack, which killed eleven people and injured dozens more. The class action seeks damages for mental and physical injuries, loss of income, and punitive damages, alleging reckless disregard for public safety. Lo is currently facing eleven counts of first-degree murder and has been deemed fit to stand trial. The lawsuit is still awaiting certification and no responses have been filed by the defendants.
