Justice Ward Branch determined there is “some basis in fact” to the claim that railway operations contributed to the “horrific fire,” noting the parallel tracks running through the town. The certification follows the denial of a competing class-action in 2023, and multiple individual and First Nations lawsuits filed after the disaster. Carel Moiseiwitsch, whose home and business were destroyed in the fire, is the representative plaintiff in the certified action.
