Lawsuit aims to stop Washington County spending federal money on jail expansion
Summary
A local resident, Frank McConnell Mayfield III, is suing Washington County, alleging the county is violating Treasury Department rules by using $18.8 million in American Rescue Plan Act (ARPA) funds to expand the county jail. The lawsuit, filed in Washington County Circuit Court, seeks to halt construction and compel the county to repay funds already spent. This action follows a 2022 voter rejection of a sales tax increase for jail expansion, after which the Quorum Court approved using ARPA funds. Mayfield argues the expansion contradicts Treasury rules prohibiting funds for “congregate facilities” and ignores previous recommendations for criminal justice reform.
The county has previously faced legal challenges regarding the use of these funds, with a similar lawsuit dismissed in federal court due to lack of standing. County officials have not yet commented on the new lawsuit, but a spokesman criticized the timing of the announcement, coinciding with a funeral attended by many county administrators. Mayfield also contends the county’s policies, including cash bail and housing federal detainees, contribute to overcrowding and that the county has disregarded expert advice and citizen concerns.
Mayfield further warns of potential financial repercussions, including a federal audit and the need to repay the funds if found to be used improperly. The current expansion project is expected to be completed by next fall, and includes increased bed space, expanded intake and medical areas, and additional space for administration and a courtroom.
