BYD Files Lawsuit Challenging Trump’s Tariffs in US Court

BYD is suing the U.S. government, seeking refunds for duties paid under Trump-era tariffs on imported materials.

China’s BYD Co., the world’s largest electric vehicle manufacturer, has filed a lawsuit in the U.S. Court of International Trade challenging the legality of tariffs imposed by former President Donald Trump. The lawsuit, filed on January 26th, argues that the executive orders supporting the tariffs are invalid, rendering the duty collection unlawful. This action joins over 1,000 other companies, including Costco and Goodyear, seeking billions of dollars in refunds.

BYD stated it has already paid and continues to pay “significant” duties on materials imported to support its U.S. operations, where it designs and manufactures electric buses and trucks. Despite being a global leader in EV production, BYD currently does not sell passenger cars in the U.S. due to these substantial tariffs and a complex regulatory landscape.

A Supreme Court decision regarding the legality of Trump’s tariffs is still pending. BYD’s lawsuit seeks independent judicial relief and assurance of a refund, as they are not confident in receiving one without their own judgment. Trump himself has warned that being forced to issue refunds would be a “National Security catastrophe.”
