The White House has pledged to vigorously defend the president’s actions, asserting his authority to address international payment problems and balance-of-payments deficits.
This legal challenge follows a Supreme Court ruling on February 20th that limited Trump’s tariff authority. While Trump has previously used tariffs as a key foreign policy tool, the states argue he is misapplying the Trade Act of 1974, which was designed to address archaic monetary risks, not general trade imbalances. The court is also currently processing thousands of refund requests from businesses related to previously imposed IEEPA tariffs.
