Musk’s claim is based on an analysis by expert witness C. Paul Wazzan, who argues that Musk’s $38 million donation accounted for 50% to 75% of the value of OpenAI’s original non-profit arm. A jury trial is scheduled to begin on April 28th.

Musk co-founded OpenAI in 2015 but left the board in 2018 due to disagreements with Altman. He later founded xAI, a competing AI lab, and has been a vocal critic of OpenAI’s shift to a for-profit structure and its partnership with Microsoft.
