Lawsuit Alleges Microbetting Product by DraftKings, FanDuel, NFL Leads to Addiction
Summary
DraftKings, FanDuel, Genius Sports, and the NFL are facing a product liability lawsuit in Pennsylvania claiming their microbetting product is “inherently dangerous” and promotes addiction. The Public Health Advocacy Institute (PHAI) filed the suit on behalf of two residents who allege the platforms use AI and constant notifications to encourage excessive betting. Plaintiffs Christopher Sage and Terry Thompson claim to have lost substantial amounts of money – Sage over $170,000 and Thompson over $1.85 million – and suffered severe emotional and physical harm, including depression and suicidal thoughts. The lawsuit accuses the companies of a coordinated effort to convert sports fans into constant gamblers, utilizing immersive marketing and customized algorithms. PHAI notes the significant growth in sports gambling revenue, from $430 million in 2018 to a projected $16.96 billion in 2025, and argues the defendants prioritized profit over consumer well-being. The plaintiffs are seeking damages under Pennsylvania’s consumer protection laws, alleging design defects, failure to warn, and negligence.
