The lawsuit stemmed from concerns raised by the FDA during a May 2024 inspection of the company’s Sanford, Maine facility regarding compliance with Current Good Manufacturing Processes. While the company maintains it did not violate any laws and denies wrongdoing, it agreed to the settlement to avoid litigation costs.

Customers who purchased Tom’s toothpaste between November 21, 2020, and March 6, 2026, for personal use are eligible to file a claim. Those without proof of purchase can receive the average retail price (currently $5.99) for one tube, while those with proof of purchase may receive a full refund for up to three products.

Claims can be submitted online, by mail, or by requesting a form via phone or email. The deadline for submission is July 6, 2026, with a final approval hearing scheduled for September 10, 2026.
