Elon Musk seeks ouster of OpenAI CEO Sam Altman in lawsuit escalation

Elon Musk is suing OpenAI to revert its for-profit status and seeks to remove CEO Sam Altman and President Greg Brockman from their positions.

Summary

Elon Musk is escalating his legal challenge against OpenAI, seeking the removal of CEO Sam Altman and President Greg Brockman as part of an effort to reverse the company’s transition to a for-profit entity. In a Tuesday court filing, Musk stated his goal is to “unwind OpenAI’s for-profit conversation and restructuring” and restore the firm’s original nonprofit status. He also intends for any damages won at trial to benefit OpenAI’s charitable arm.

Musk’s lawsuit alleges that OpenAI abandoned its founding mission when it accepted billions in funding from Microsoft and restructured for profit. He previously indicated a potential claim for $134 billion in damages. OpenAI dismissed the lawsuit as a “harassment campaign” motivated by “ego, jealousy and a desire to slow down a competitor.”

The filing followed a request from OpenAI’s chief strategy officer for California and Delaware attorneys general to investigate Musk for potentially anti-competitive behavior. Musk co-founded OpenAI in 2015 but left the board in 2018, later establishing xAI as a rival AI company. OpenAI previously rejected Musk’s $97.4 billion bid to acquire the nonprofit controlling the company.
