Elon Musk Demands Removal of OpenAI CEO Sam Altman Amid Lawsuit — Report

Elon Musk is seeking the removal of OpenAI CEO Sam Altman and President Greg Brockman due to a lawsuit alleging the company acted fraudulently.

Summary

Elon Musk’s legal battle with OpenAI and its CEO Sam Altman has escalated, with Musk now demanding Altman and President Greg Brockman’s removal from their positions. The lawsuit, filed in 2024, centers on Musk’s claim that OpenAI “deceived” him into donating $38 million by initially presenting itself as a non-profit organization. Musk alleges that OpenAI has strayed from its original mission and is now prioritizing profit.

In recent court filings, Musk’s lawyers stated they will request a judge and jury to order the removal of Altman from the OpenAI nonprofit board and both Altman and Brockman from their roles in the for-profit arm of the company. They argue that removing officers and directors is a standard remedy when individuals fail to uphold a charity’s mission. Musk also seeks to revert OpenAI to its original non-profit status, citing the company’s restructuring last October which resulted in a 26% stake for the non-profit in the for-profit entity, which includes ChatGPT.

OpenAI responded to the filings via X, accusing Musk of hypocrisy and claiming the lawsuit is motivated by a desire for power, money, and a wish to hinder a competitor. Jury selection is scheduled to begin on April 27th in Oakland, California, suggesting the case is moving towards trial.
