The jury will specifically decide whether Microsoft knowingly assisted OpenAI in breaching its obligations to donors like Musk. While the judge dismissed Musk’s claim that Microsoft unfairly profited from the situation due to insufficient evidence, she acknowledged “considerable evidence” suggesting Microsoft was aware of potential wrongdoing.

Recent corporate changes, including Microsoft acquiring a 27% stake in OpenAI, were intended to maintain a nonprofit oversight of for-profit operations, aligning with CEO Sam Altman’s vision. However, Musk and Altman have been in disagreement since 2024, with Musk’s xAI now a key competitor to OpenAI.
